General Terms & Conditions of Sale
Recitals
Apothicom Distribution (hereinafter referred to as "Apothicom") provides its customers (hereinafter referred to as the "Customer" or "Customers") with harm reduction tools in the context of drug use (hereinafter referred to as the "Product" or "Products") via its website www.apothicom.org (hereinafter referred to as the "Website").
There are two (2) separate services for orders on the Website. Orders made by Private Customers (hereinafter referred to as "Orders by Private Customers") correspond to all purchases made via the "Private Customers" page. Orders made by Professional Customers (hereinafter referred to as "Orders by Professional Customers") correspond to all purchases made via the "Professional Customers" page by public health organisations, medical equipment distributors, and companies.
These General Terms & Conditions of Sale (hereinafter referred to as the "GTCS") govern all sales of Products on the Website and complement the General Terms & Conditions of Use (hereinafter referred to as the "GTCU") of the Website.
These GTCS prevail above all other general and/or specific terms and conditions that are not expressly agreed upon by Apothicom.
Apothicom reserves the right to modify these GTCS and the GTCU of the Website at any time. In this event, the applicable terms and conditions are those in force on the date on which the Customer places an order.
Conditions for placing an order:
Potential or existing Customers who wish to purchase a Product or service via the Website must:
- Fill out an identification form with their contact information and other pertinent details, or provide their customer account number if applicable;
- Select the desired Product(s);
- Verify, then place their order;
- Pay for their order in accordance with the specified payment terms and methods;
- Confirm that their order has been placed and that payment has been made. Orders by Professional Customers can be paid according to usual payment terms.
Confirmed orders imply the acceptance and acknowledgement of these GTCS, and the renunciation of the right to invoke their own general terms and conditions of purchase or otherwise.
The information provided and the recorded confirmation of the order constitute proof of the transaction. The confirmation of the order constitutes the signature and acceptance of the transaction. Apothicom shall notify the Customer, via the Website and via email, of the confirmation of the order.
Characteristics of the goods and services provided:
The Products and services provided are featured in the catalogue published on the Website. All orders referring to another catalogue or source shall be deemed null and void.
Products are available while stocks last.
Each Product is accompanied by a description, provided by Apothicom.
The photographs contained within the catalogue are non-contractual.

Prices
The prices featured in the catalogue are expressed in Euros (€), inclusive of the French VAT rate applicable on the date of the order – any changes to this rate will be reflected in the prices of the Product(s).
Orders delivered to countries within the European Union shall be inclusive of local VAT rates. If you have any questions, contact us via the Contact form.
Apothicom reserves the right to modify its prices at any time, although the Customer shall benefit from the prices featured in the catalogue on the date of the order.
These prices are not inclusive of shipping costs.
Customs duties
All orders placed via the Website for delivery to a country outside Mainland France may be subject to local customs duties and taxes.
Customers are financially liable for any customs duties and taxes relating to the delivery of a Product or Products, and are responsible for inquiring about such obligations with their country's authorities. Apothicom is not required to verify and inform its Customers thereof.
Payment terms
Payment is due upon placing an order.
For account consignors, invoices are due within 45 days of the end of the month or 60 days of the invoice date.
No deductions will be afforded for early payments.
By explicit agreement and unless a deferment has been promptly requested and approved by Apothicom, the non-payment of invoices within the deadline set out shall result in a formal notice, followed by:
- The immediate payment of all sums initially due;
- The payment of late fees equal to three (3) times the legal interest rate in force, as set out in French Decree no. 2009-138 of 9 February 2009;
- A flat-rate recovery fee of forty euros (€40) as set out in French Decree no. 2012-1115 of 2 October 2012 concerning business transactions as defined in Article L. 441-6 of the French Commercial Code.
For all initial Orders by Professional Customers, advance payment is required. In some cases, advance payment guarantees may also be required.
Payment methods
Payments for Orders by Private Customers are to be made in Euros (€) via:
- Bank card: Payments are made via the 3-D Secure authentication protocol over SSL (Secure Socket Layer) connections, which uses a program to encrypt all data shared, thus ensuring that third parties cannot access this data as it transits through the network.
Payments for Orders by Professional Customers are to be made in Euros (€) via:
- Bank transfer: All bank transfer fees shall be borne by the Customer.
- Bank card: Payments are made via the 3-D Secure authentication protocol over SSL (Secure Socket Layer) connections, which uses a program to encrypt all data shared, thus ensuring that third parties cannot access this data as it transits through the network.
- Apothicom reserves the right to refuse an order if the payment method(s) used do not comply with the abovementioned conditions. In this event, the Customer shall be liable for any potential transaction fees.
Invoices are sent via the Customer's online account on the Website and via email to the invoicing email address.
Retention of ownership
Apothicom reserves the right to retain ownership of the goods pending full payment of the invoice.
Delivery
Products are delivered to the address indicated on the purchase order.
The Customer is responsible for inspecting the goods and their condition upon receipt, in accordance with Annex II of the French Transport Code. In the event of damage, the Customer must note their reservations on the carrier's receipt and take one or more photographs of the damage. The damage must be described with precision. The Customer must inform Apothicom within 24 hours.
The shipping costs, based on the location and transport options chosen by the Customer, are available under Delivery information on the Website. The shipping costs featured on the Website only apply to Private Customers (Shipping costs – Private Customers) and public health organisations such as harm reduction centres for drug users; centres for care, support and the prevention of addiction; needle and syringe programmes; and safe injection facilities (Shipping costs – Professional Customers). The shipping costs for distributors and companies are invoiced at cost.
Warranties
All Products provided by Apothicom are covered by legal warranties as defined in Article 1641 et seq. of the French Civil Code.
In the event of non-conformity of one of the Products sold, said Product may be returned to Apothicom for an exchange or a refund. The Product must be returned in its original packaging. Apothicom will provide a return slip, which must be filled out and sent back with the returned Product. The cost of return shipping shall be borne by Apothicom.
All claims must be submitted via the Contact form on the Website, indicating the nature of the non-conformity.
Cancellations
Customers who are non-professional natural persons benefit from a cooling-off period of fourteen (14) days following the date of receipt of their order, during which they can decide to return the Product(s) ordered for an exchange or a refund without penalty.
Refunds shall be issued within fourteen (14) days of receiving the returned Product(s). Refunds shall be issued for the unopened, undamaged Product(s) only, and shall exclude shipping costs. The cost of return shipping for the Product(s) concerned shall be borne by the Customer at their own risk.
No returns shall be accepted without a return slip.

Requests for exchanges or refunds
In the context of Orders by Professional Customers, and on an exceptional basis, requests for exchanges or refunds may be accepted. Upon mutual agreement, Apothicom will issue a return slip to the Customer.
The cost of return shipping for the Product(s) concerned shall be borne by the Customer at their own risk.
Refunds shall be issued within fourteen (14) days of receiving and inspecting the returned Product(s). Refunds shall be issued for the unopened, undamaged Product(s) only, and shall exclude shipping costs.
No returns shall be accepted without a return slip.
All requests for exchanges and refunds must be submitted via the Contact form on the Website within seven (7) days of receipt.
Personal data / Privacy
In accordance with the Data Privacy Act of 6 January 1978 as amended, relative to IT, files, and liberties, nominative data pertaining to Customers may be automatically processed.
Apothicom reserves the right to collect data pertaining to Customers, including through the use of cookies.
Customers have a right to access, correct, and delete their personal data pursuant to the Data Privacy Act of 6 January 1978 as amended.
Apothicom undertakes to comply with rules pertaining to confidentiality and personal data processing in accordance with the General Data Protection Regulation (GDPR), applicable as of 25 May 2018. In order to fulfil its contracts with its Users, Apothicom shares certain data collected with its partners, who undertake to not use said data for commercial purposes.
Applicable law: These GTCS are subject to French law.
