General Terms & Conditions of Use of the Apothicom Distribution Website

Article 1: Subject

These General Terms & Conditions of Use (hereinafter referred to as the "GTCU") legally govern the use of the Website www.apothicom.org (hereinafter referred to as the "Website").

These GTCU constitute the Contract between Apothicom Distribution (hereinafter referred to as "Apothicom") and the users (hereinafter referred to as the "User" or "Users"), by which said the latter must abide in order to access the Website.

Article 2: Legal notices

Article 3: Access to the Website

The Website provides access to the following services:

- Sales of harm reduction tools in the context of drug use;

- Guidance on the use of harm reduction tools and documentation.

All use of the Website is subject to these GTCU as well as Apothicom's General Terms & Conditions of Sale for products sold via the Website.

The Website can be accessed for free by any User with an internet connection. All fees necessary to access the services provided (IT hardware, internet connection, etc.) shall be borne by the User.

Services dedicated to members can be accessed using a username and a password.

Access to the Website may be interrupted or suspended by the publisher, for maintenance or otherwise, without notice nor justification.

If a User does not consent to one or more of the provisions of these GTCU, they are invited to immediately cease using the Website.

Article 4: Collection of data

Upon signing in to the Website and creating a User account, the collection of data is both necessary and mandatory.

In accordance with Data Privacy Act no. 78-17 of 6 January 1978 as amended, relative to IT, files, and liberties:

  • Personal data shall be collected and processed in compliance with privacy laws;
  • Nominative data pertaining to customers may be automatically processed.

Apothicom reserves the right to collect data pertaining to Users, including through the use of cookies. Apothicom undertakes to comply with rules pertaining to confidentiality and personal data processing in accordance with the General Data Protection Regulation (GDPR), applicable as of 25 May 2018.

In accordance with Data Privacy Act no. 78-17 of 6 January 1978 as amended, relative to IT, files, and liberties, Users have the right to access their personal data, to have it corrected or deleted, and to oppose its processing. This right can be exercised via:

In order to fulfil its contracts with its Users, Apothicom shares certain data collected with its partners, who undertake to not use said data for commercial purposes.

Article 5: Intellectual property

The brands, logos, and content featured on the Website (graphs, illustrations, texts, etc.) are protected by the Intellectual Property Code and copyright laws.

The texts, images (photos, designs, logos, etc.), videos, and articles featured on the Website may be used legally (distribution, sharing, etc.), subject to strict compliance with the conditions hereafter:

  • Unless previously agreed in writing by Apothicom, the commercial use and the modification (alteration, cropping, misappropriation) of original content are strictly forbidden.
  • The elements that identify the Website (mentions of Apothicom, logos, URL) must remain visible. Images and photos with no identification must be accompanied by the name "Apothicom" (appended to or with the image) along with a hyperlink to the Website www.apothicom.org.
  • The use of links or hyperlinks to the Website is strictly forbidden without Apothicom's prior written consent.

Article 6: Liability

While the information featured on the Website is deemed to be reliable, Apothicom cannot be held liable for the reliability of the sources.

The information featured on the Website is presented for the convenience of the User and is of no contractual value. Despite regular updates, Apothicom cannot be held liable in the event of modifications to the administrative and legal provisions that should appear following the publication of such information on the Website. Moreover, Apothicom cannot be held liable for the use and interpretation of the information provided on the Website.

Apothicom cannot be held liable for any inaccessibility of the Website due to technical issues.

Apothicom cannot be held liable in the event of force majeure or any unforeseen or insurmountable issues caused by a third-party.

Apothicom undertakes to implement all necessary means to ensure that all data remains secure and confidential.

There may be hyperlinks featured on the Website. By clicking on these hyperlinks, the User shall leave the Website. Apothicom cannot be held liable for the content contained on these external websites, over which it has no control.

Article 8: Cookies

Article 9: Archiving – Proof

Apothicom archives purchase orders and invoices via safe and sustainable means, in order to retain a reliable copy thereof, in accordance with the provisions of Article 1348 of the French Civil Code.
Apothicom's digital records shall be deemed by the parties as proof of communication, orders, payment, and transactions between the parties.

Article 10: Duration of the Contract

This Contract is valid for an indefinite period. This Contract shall take effect as of the date on which the services provided on the Website are first used by the User.

Article 11: Applicable law – Assignment of jurisdiction

This Contract is subject to French law. Any dispute that cannot be settled amicably between the parties shall fall within the jurisdiction of the French courts.
